They outline important details regarding your use of our services, including your legal rights, responsibilities, and any limitations or liabilities that may apply. If you disagree with any part of these Terms, we kindly ask that you refrain from using Page Speed Group.
1. GENERAL
1.1 These Page Speed Group Terms and Conditions (the âTermsâ) govern your access to and use of the website https://pagespeedgroup.com (the âWebsiteâ), the content provided through the Website, and the related services (collectively referred to as âPage Speed Groupâ). These Terms form a legally binding agreement between you, whether as an individual user or a business entity (âyouâ or âyourâ), and the operator of Page Speed Group, which is One Click Capital, LLC, a company registered in the United States (âweâ, âusâ, or âourâ).
1.2 License to Use Page Speed Group - We grant you a personal, revocable, non-exclusive, non-transferable, and limited license to use Page Speed Group in accordance with these Terms. This license is valid worldwide and is subject to your compliance with all provisions outlined in this agreement.
1.3 About Page Speed Group - Page Speed Group specializes in performance optimization for Shopify websites. We provide information, tools, and services focused on improving website performance, including but not limited to performance audits, optimization solutions, and tailored strategies to help businesses achieve exceptional Google Page Speed Insights scores (collectively, the âProducts and Servicesâ).
1.4 Third Parties - These Terms apply solely to your use of Page Speed Group. Unless required by applicable law, we are not responsible or liable for the actions, omissions, or services provided by third parties. This includes, but is not limited to, the quality of third-party services, content published by third parties, and the security or privacy practices employed by third-party websites, applications, or services.
1.5 Privacy - We are committed to safeguarding your privacy and complying with all applicable data protection laws. Before using Page Speed Group, we strongly encourage you to review our Privacy Policy, available at https://pagespeedgroup.com/pages/privacy-policy, and our Cookie Policy, available at https://pagespeedgroup.com/pages/cookie-policy (collectively, the âPrivacy Policyâ). These documents provide detailed information about how we collect, use, and protect your personal data.
1.6 Minors - Page Speed Group is not intended for use by individuals under the age of 18. If a person under the age of 18 wishes to use Page Speed Group, a parent or legal guardian must contact us to provide explicit consent on their behalf.
1.7 Support - For customer or technical support, please contact us by email at support@pagespeedgroup.com. We will make every effort to respond to your inquiries without undue delay, and no later than 3 business days after receiving your request.
2. DISCLAIMER
2.1 Disclaimer - The information provided on Page Speed Group is intended for informational and educational purposes only. While we strive to ensure the accuracy and usefulness of our Products and Services, it is your responsibility to verify the completeness, accuracy, and applicability of any information or resources found on Page Speed Group.
2.2 Accuracy of Information - While we make every effort to monitor and maintain the information available on Page Speed Group, we cannot guarantee the truthfulness, reliability, timeliness, relevance, or completeness of all content provided on our website or Shopify platform where we host our website.
2.3 Limitation of Responsibility - We are not responsible or liable for any consequences, whether direct or indirect, that arise from actions or decisions you make based on the information provided on or linked to Page Speed Group. You use such information at your own risk.
2.4 No Guarantees - No information, including testimonials or case studies, presented on Page Speed Group should be interpreted as a warranty, guarantee, or prediction of specific results from using our Products and Services. Individual outcomes may vary based on unique circumstances.
3. FEES, PAYMENTS, AND REFUNDS
3.1 Steps to Conclude a Contract - To conclude a paid contract with us, you must:
(i) Visit the Page Speed Group Website;
(ii) Select the Products and Services you wish to purchase;
(iii) Add the selected items to your cart and proceed to checkout;
(iv) Provide the required personal and payment information.
You will have the opportunity to review and correct any errors before completing the payment. After payment is processed, we will send a confirmation email. By completing the payment and receiving the confirmation email, you enter into a service contract with us based on these Terms. Specific contract details are not stored by us, but you may contact us for any information regarding your purchase.
3.2 The Fees - A portion of the Products and Services offered by Page Speed Group are subject to applicable fees (the âFeesâ), which may be charged on a subscription basis or as one-time payments. The schedule of Fees is available on our Website or communicated to you directly. Unless stated otherwise, the Fees include applicable sales tax. By ordering paid Products and Services, you agree to pay the Fees in accordance with these Terms, the specific terms of the Fees, and any other conditions in effect at the time of purchase. Fees remain valid as long as they are displayed on our Website or communicated by us. We reserve the right to change the Fees with notice to you (if you have an active service contract) or without notice (if you do not have an active service contract).
3.3 Payment - All payments for Page Speed Group are processed by our third-party payment processor, Stripe. Stripe may collect personal data, such as your name, credit card number, and billing address, to facilitate payment processing. Stripe handles all aspects of the payment process, including data collection and processing, under its own terms and policies. You are responsible for ensuring that all payment information is accurate and that sufficient funds are available. We are not liable for payments that fail due to incorrect payment details or Stripeâs refusal to process the payment.
3.4 Invoices - Invoices for paid Fees are sent to you upon confirmation of your order or shortly thereafter.
3.5 Delivery of Products and Services - Our Products and Services are delivered digitally. You acknowledge and agree that:
- If you purchase a One-time Performance Optimization for a group of selected Shopify templates, you will receive a detailed report and performance recommendations upon completion of the service;
- Following the completion of the One-time Performance Optimization, you will have a period of seven (7) calendar days to subscribe to an Ongoing Performance Maintenance plan;
- After the expiration of the seven (7) day period, you will no longer be eligible to purchase an Ongoing Performance Maintenance subscription related to the completed One-time Performance Optimization, as the Products and Services will no longer fall under the guarantee described in Section 3.9 of these Terms;
- If you purchase an Ongoing Performance Maintenance subscription, you will be granted access to applicable tools, resources, and services as outlined in your selected plan.
3.6Â Subscriptions - By entering into a subscription agreement with us, you agree to pay the Fees in accordance with these Terms, the terms of your chosen payment plan, and any other applicable conditions. You acknowledge and agree that:
(i) You will first complete One-time Performance Optimization service with Page Speed Group, because without One-time Performance Optimization service you will not be able to enter into a subscription agreement with us;
(ii) You will pay the Fees for each billing cycle;
(iii) Fees are billed at the beginning of each billing cycle as automatic recurring payments;
(iv) We will automatically renew your subscription based on its renewal cycle and charge your payment method unless you cancel your subscription before the current term expires.
If we are unable to charge your payment method, your access to the purchased Products and Services will automatically terminate. All details about your payments, including invoices, billing cycles, and payment plans, are accessible through your User Account.
3.7 Cancellation of Subscription - To avoid automatic renewal and charges, you must cancel your subscription at least 7 calendar days before the end of the current billing period. Cancellation can be done through your User Account or by contacting Page Speed Group. Cancellations requested with less than 7 daysâ notice may not be guaranteed. Inactivity on our platform does not constitute a cancellation request. If less than 7 daysâ notice is provided, you agree to pay a disruption fee of USD $500 to cover administrative costs.
3.8 Right of Withdrawal - If you are using Page Speed Group as a consumer, you may withdraw from the service contract within 14 days of its conclusion, unless:
(i) The services have already been fully provided; or
(ii) You are using free Products and Services.
To exercise your right of withdrawal, notify us by email at support@pagespeedgroup.com. You may use the model withdrawal form provided at the end of these Terms or submit your request in your own words. If you have used the Products and Services before withdrawing, we reserve the right to refund only the portion of the Fees representing unused services. Refunds will be issued using the same payment method used for the original payment. Businesses, traders, or professional users are not entitled to this right of withdrawal.
3.9 Refunds - We issue refunds for purchased Products and Services under the following conditions:
- If you purchase a One-time Performance Optimization service, we offer a 7-day money-back guarantee if you are unsatisfied.
- If you purchase an Ongoing Performance Maintenance subscription, we offer a 30-day money-back guarantee if you are unsatisfied. Inactive accounts are not eligible for refunds, but we may credit your account with a free period based on your payment history.
Refunds are processed within 5-10 business days and returned to the original payment source.
3.10 No Refunds - We reserve the right to deny refund requests if:
- The Products and Services are customized or made to your specifications
- The Products and Services have been altered or damaged;
- There is evidence that you have used or are using the Products and Services; or
- We believe your refund request is abusive.
3.11 Faulty Products and Services - If you receive faulty Products or Services, you may, within 7 days of receipt, contact us to:
- Request a remake of the Products and Services;
- Request a refund as described above;
- Request a reduction of the Fees; or
- Request a replacement with the same or similar non-faulty Products and Services.
4. THE USER ACCOUNT
4.1 Registration of the User Account - To access the full functionality of Page Speed Group, including our Products and Services, you must register a user account (the âUser Accountâ). We reserve the right, at our sole discretion, to refuse to register any User Account for any reason. By creating your User Account, you acknowledge, agree, and warrant that:
- You are a human individual and not a machine (User Accounts registered by bots, automated scripts, or other non-human methods are strictly prohibited);
- You have the legal capacity to enter into binding agreements with us;
- You agree to comply with these Terms and all applicable local, state, national, and international laws, treaties, and regulations in connection with your use of Page Speed Group;
- You will provide only true, accurate, complete, and up-to-date personal information during registration;
- You will create and maintain only one User Account; and
- You are solely responsible for all activities, information, and actions that occur under your User Account.
4.2 Authorization - If you are acting on behalf of a business entity when accepting these Terms or registering a User Account, you warrant and confirm that you have the necessary authority to bind that entity to these Terms. By creating the User Account and providing the business entityâs details, you confirm that you are an authorized employee, contractor, or representative of the entity and have the legal right to act on its behalf. We are not responsible or liable for any actions taken without proper authorization.
4.3 Personal Data Provided Through the User Account - The collection and use of your personal data are governed by our Privacy Policy. Your personal data will only be used for the purposes explicitly outlined in the Privacy Policy. We encourage you to review our Privacy Policy regularly to stay informed about our data protection practices and any updates.
4.4 Security of the User Account - You are solely responsible for maintaining the confidentiality of your User Account, including safeguarding your login credentials and passwords. You agree to notify us immediately if you suspect any unauthorized use of your User Account or any other security breach related to your account. Additionally, you are responsible for accessing Page Speed Group through secure internet connections and protected networks. We cannot and will not be liable for any loss or damage resulting from your failure to comply with these security obligations.
4.5 Suspension and Termination of the User Account - We reserve the right to suspend or terminate your User Account if, in our sole discretion, we believe that your use of Page Speed Group seriously or repeatedly violates these Terms. Additionally, we may suspend or terminate your account in response to a lawful request from a public authority.
4.6 Deactivation of the User Account - You may deactivate your User Account at any time. Once your account is deactivated, these Terms will no longer apply to you.
4.7 Assignment of the Account - You are not permitted to assign your rights under these Terms, and your User Account is non-transferable to any other individual or entity.
5. INTELLECTUAL PROPERTY
5.1 Our Content - The majority of content available on Page Speed Group is owned by us, our partners, agents, licensors, vendors, or other content providers (âOur Contentâ). This includes, but is not limited to, text, images, logos, photos, audiovisual content, source code, trademarks, service marks, and trade names. Our Content is protected by applicable intellectual property laws and international treaties. These Terms do not transfer any intellectual property rights to you, and all rights, titles, and interests in such property remain solely with us or the respective third-party owners.
5.2 Third-Party Intellectual Property - Some trademarks and intellectual property featured on Page Speed Group are owned by third parties. Such property does not belong to us and remains the sole property of the respective third-party owners. You agree not to infringe on these third-party rights.
5.3 Restrictions on Use - Without prior written authorization from us, you are not permitted to:
- Distribute Our Content;
- Copy Our Content;
- Disassemble, alter, decompile, reverse engineer, translate, or adapt Our Content; or
- Rent, loan, lease, or attempt to grant other rights to Our Content to third parties.
5.4 The Page Speed Group Brand - You may not use the Page Speed Group brand, including its word or figurative trademarks, or any third-party trademarks without prior consent from the trademark owner. You are prohibited from using such brands or trademarks in a way that suggests sponsorship, endorsement, or association with us without our prior written permission.
5.5 Copyright Infringement Claims - If you believe any content on Page Speed Group violates your or a third partyâs intellectual property rights, please contact us with your concerns or a request to remove the allegedly infringing content. We will respond to your claim as soon as possible, but no later than 2 weeks. Ensure your claim is signed and includes sufficient information to help us locate the allegedly infringing content.
6. USER-GENERATED CONTENT
6.1 Comments - You may submit comments under blog posts, reviews of Products and Services, or other commentary, if the functionality of Page Speed Group allows it (collectively, âCommentsâ). Please note that your Comments may become publicly available. Therefore, you must:
- Exercise due diligence when submitting Comments;
- Avoid sharing sensitive information; and
- Ensure your Comments comply with these Terms and applicable laws.
6.2 Prohibition on Sharing Personal Data - You are not allowed to share personal data of individuals who have not authorized or consented to its disclosure (e.g., names, contact details) through Comments.
6.3 License to Use Comments - By submitting Comments, you grant us unrestricted, sub-licensable, royalty-free, perpetual, and irrevocable rights to use, distribute, advertise, adapt, remix, modify, publicly display, publicly perform, excerpt, prepare derivative works of, and reproduce your Comments for the purposes of carrying out our legitimate business interests.
6.4 Monitoring and Moderation - To ensure the security of Page Speed Group, we may, but are not obligated to, monitor or review Comments. We reserve the right, at our sole discretion, to refuse, modify, delete, or remove Comments, in whole or in part, that violate these Terms or harm the reputation of Page Speed Group. However, you remain solely responsible for your Comments.
6.5 Disclaimer on Comments - Comments reflect your personal views and recommendations and do not represent our views, endorsements, or commitments.
7. PROHIBITED USE
7.1 General Guidelines - When using Page Speed Group, you must adhere to the guidelines outlined in this section. We work closely with law enforcement and will report any content or activities that violate applicable laws.
7.2 Prohibited Activities - You are not permitted to use Page Speed Group in any way that contributes to or involves the following activities (this list is representative and not exhaustive):
- Engaging in unlawful activities, including violations of laws, statutes, ordinances, or regulations;
- Committing fraud or providing false, inaccurate, or misleading information;
- Sharing content that depicts or incites violence, physical harm, or emotional distress;
- Spreading malware (e.g., viruses, worms, Trojan horses), spam, or illegal messaging;
- Distributing ethnically, racially, or otherwise objectionable information;
- Sharing sexually explicit, nude, libellous, harassing, violent, defamatory, abusive, profane, vulgar, threatening, hateful, obscene, or terrorism-related content;
- Advertising or encouraging the use of tobacco, alcohol, or illegal substances;
- Copying, distributing, renting, reselling, modifying, compromising, damaging, disabling, impairing, or overburdening Page Speed Group;
- Interfering with or abusing other users of Page Speed Group;
- Using bots, scripts, or other automated methods; and
- Collecting or disclosing information about other users of Page Speed Group without their consent.
7.3Â Reporting Inappropriate Content - If you believe any content on Page Speed Group is inappropriate, violates these Terms, applicable laws, or your rights (including privacy), please contact us immediately at support@pagespeedgroup.com.
8. THIRD-PARTY LINKS
Page Speed Group may contain links to websites and services owned, operated, or controlled by third parties. Please note that we are not responsible for the business practices, content, or security measures of these third-party sites. We encourage you to exercise caution when leaving our platform and to carefully evaluate any third-party website or service you access.
9. FEEDBACK
You may submit feedback (e.g., ideas, suggestions, proposals, or other materials) about our Products and Services to us via email or other means. By submitting feedback, you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate, and otherwise use your feedback in any medium. We are under no obligation to: (i) Keep your feedback confidential; (ii) Compensate you for your feedback; or (iii) Respond to your feedback.
10. DISCLAIMER OF WARRANTIES
10.1 Use at Your Own Risk - You agree that your use of Page Speed Group is entirely at your own risk. Page Speed Group is provided on an âas isâ and âas availableâ basis. To the fullest extent permitted by law, we expressly disclaim all warranties, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10.2 No Guarantees - We make no warranties that:
- Page Speed Group will meet your requirements;
- Page Speed Group will be uninterrupted, timely, secure, or error-free;
- The results obtained from using Page Speed Group will be accurate or reliable; or
- Any defects in Page Speed Group will be corrected.
11. LIMITATION OF LIABILITY
11.1 Exclusion of Liability - To the fullest extent permitted by applicable law, we, our affiliates, founders, officers, directors, employees, agents, suppliers, or licensors shall not be liable to any person for any indirect, incidental, special, punitive, cover, or consequential damages. This includes, without limitation, damages for lost profits, revenue, sales, goodwill, use, or content; business interruption; loss of anticipated savings; or loss of business opportunity. This applies regardless of the legal theory (contract, tort, warranty, breach of statutory duty, negligence, or otherwise) and even if we have been advised of the possibility of such damages or could have foreseen them.
11.2 Jurisdictional Limitations - Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the limitations in this section may not apply to you.
11.3 Third-Party Suppliers - By using Page Speed Group, you acknowledge that we may rely on third-party suppliers to provide software, hardware, storage, networking, and other technological services. The acts or omissions of these third-party suppliers may be beyond our control. To the maximum extent permitted by law, we exclude any liability for loss or damage resulting from the acts or omissions of such third-party suppliers.
12. INDEMNIFICATION
You agree to indemnify and hold us, our affiliates, founders, directors, officers, employees, and agents harmless from and against any liabilities, losses, damages, or costs, including reasonable attorneysâ fees, arising from or related to:
- Any third-party allegations, claims, actions, disputes, or demands asserted against us due to your use of Page Speed Group; or
- Any willful misconduct on your part.

13 AVAILABILITY
13.1 Reasonable Efforts - We make reasonable efforts to ensure that Page Speed Group is always accessible. However, its availability may be affected by factors beyond our control, such as bandwidth issues, equipment failure, or force majeure events, including but not limited to:
- Acts of God;
- Strikes or work stoppages;
- Accidents;
- Acts of war or terrorism;
- Civil or military disturbances;
- Natural or nuclear disasters;
- Supply shortages; and
- Technical breakdowns.
We are not responsible for any unavailability caused by such factors. If you encounter issues while using Page Speed Group, please contact us immediately.
13.2 Changes to Services - We reserve the right, at our sole discretion, to modify, suspend, or discontinue any aspect of Page Speed Group and its services at any time. This includes changes to technical features, content, databases, availability, and equipment requirements. We may also impose limits on certain features or restrict your access to parts or all of Page Speed Group without notice or liability.
14. TERM AND TERMINATION
14.1 Term - These Terms take effect on the date indicated at the top of this document and remain in force until terminated by us or until you stop using Page Speed Group. We reserve the right, at our sole discretion, to terminate these Terms and the provision of Page Speed Group at any time, with notice to you if applicable. Your rights under these Terms will automatically terminate if you fail to comply with any provision of these Terms. Upon termination, you must cease all use of Page Speed Group.
14.2Â Breach of the Terms - If we believe, at our sole discretion, that you have violated these Terms, we may take the following actions as appropriate, necessary, or desirable:
- Issue a formal warning to you;
- Temporarily or permanently restrict your access to Page Speed Group;
- Temporarily or permanently restrict your access to the Products and Services;
- Report you to law enforcement authorities; or
- Initiate legal action against you.
14.3 Merger or Acquisition - If we are acquired, merged, or sell all or substantially all of our assets during the term of these Terms, these Terms will not automatically terminate. We will use our best efforts to ensure that the transferee or surviving company assumes and is bound by these Terms.
15. ASSIGNMENT
15.1 Your Assignment - You may not assign, resell, sub-license, or otherwise transfer or delegate any of your rights or obligations under these Terms, in whole or in part, without our prior written consent. Such consent is at our sole discretion and without obligation. Any attempted assignment or transfer without our consent will be null and void.
15.2 Our Assignment - We reserve the right to assign any of our rights or obligations under these Terms, in whole or in part, to any third party as part of the sale of all or substantially all of our assets or stock, or as part of a merger.
16. CHANGES AND AMENDMENTS
16.1 Right to Modify - We reserve the right to modify these Terms, Page Speed Group policies, the Products and Services, any content available on Page Speed Group, and our business practices (including marketing policies) at any time.
16.2 Effective Date of Amendments - Any changes to these Terms will become effective upon posting the updated version on Page Speed Group and notifying you (if we have your email address).
16.3 Continued Use - Your continued use of Page Speed Group after any changes constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using Page Speed Group.
17. SEVERABILITY
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law. The unenforceable portion shall be severed from these Terms, and the remaining provisions shall remain valid and enforceable without being affected.
18. GOVERNING LAW AND DISPUTE RESOLUTION
18.1 Governing Law - The formation, interpretation, and performance of these Terms, as well as any disputes arising from them, shall be governed by the substantive and procedural laws of the State of Wyoming, United States, without regard to its conflict of law principles.
18.2 Jurisdiction - The exclusive jurisdiction and venue for any legal actions related to these Terms shall be the courts located in Sheridan, WY, United States.
18.3 Interim Injunctions - Nothing in these Terms prevents you or us from seeking interim injunctions or other preliminary relief necessary to preserve the status quo pending the resolution of a dispute, in any applicable jurisdiction.
19. ATTRIBUTION
Portions of the content, tools, or resources provided through Page Speed Group may include third-party materials licensed under free commercial use terms. We gratefully acknowledge the following creators and comply with their licensing requirements:
